Terms and Conditions

These Terms and Conditions apply to all transactions made on this website. By using this site or placing an order, you confirm that you accept these Terms and Conditions and our Privacy Policy.

Our Privacy Policy forms an integral part of these Terms. Please review it before placing an order.

Please read these Terms carefully and keep a copy for future reference.


1. Interpretation

In these Terms and Conditions (“Terms”), the following definitions apply:

  • Buyer / You: the person, firm, or company purchasing Goods from the Company.

  • Company / We / Us: ARD.COM (UK) Limited, trading as Aviation Retail Direct.

  • Contract: the agreement between the Buyer and the Company for the supply of Goods, incorporating these Terms, the Returns Policy, and the Privacy Policy.

  • Goods: any goods agreed to be supplied by the Company under the Contract.

References to statutes include any amendments or replacements from time to time.


2. The Contract

Each order placed through the website constitutes an offer by you to purchase Goods subject to these Terms. A Contract is formed once we accept your order (for example, by dispatching the Goods or issuing an order confirmation).

These Terms apply to the exclusion of any other terms the Buyer may seek to impose. No terms contained in any purchase order or other document provided by the Buyer shall form part of the Contract unless expressly agreed by us in writing.


3. Delivery and Availability

All delivery dates provided are estimates only.

  • Where no delivery date is specified, delivery will take place within a reasonable time.

  • All Goods are subject to availability and may be withdrawn at any time.

  • If we are unable to supply Goods for any reason, we will not charge you for those Goods and will refund any amounts already paid.

We are not responsible for any additional losses resulting from non-availability.


4. Claims, Shortages, and Incorrect Goods

4.1 Damaged Goods

If Goods arrive damaged, you must:

  • Note the damage on the carrier’s delivery note, and

  • notify us within 7 days of delivery.

4.2 Shortages

You must sign for the correct number of packages shown on the delivery note. Any shortages must:

  • be noted at delivery, and

  • reported to us within 10 days of delivery.

4.3 Incorrect Goods

If incorrect Goods are supplied, you must notify us within 7 days of delivery. We will arrange a replacement or refund in line with our Returns Policy.


5. Returns and Refunds

Returns, cancellations, and refunds are governed by our Returns Policy, which forms part of these Terms.

Key points include:

  • Change-of-mind returns must be requested within 14 days of receiving the Goods.

  • Sale items and pre-ordered items are non-returnable, unless faulty, damaged, or incorrect.

  • Goods must be returned unused and in a re-saleable condition.

  • Refunds are processed to the original payment method within 14 days of approval.

6. Risk and Ownership

Risk in the Goods passes to the Buyer on delivery.

Ownership of the Goods remains with the Company until full payment (in cleared funds) has been received for:

  • the Goods, and

  • any other sums owed by the Buyer.

Until ownership passes, the Buyer must:

  • hold the Goods as bailee for the Company,

  • store them separately and clearly identifiable as Company property,

  • not remove or deface identifying marks, and

  • keep the Goods insured with the Company’s interest noted.


7. Price and Payment

Payment in full is required before dispatch.

Prices shown at checkout are the total prices payable at the time of ordering and include VAT where applicable.

We reserve the right to correct pricing errors or adjust prices to reflect supplier price changes, taxes, duties, or errors. If a price changes after you place an order, you will be notified and given the option to cancel.

Payment card details are processed securely by third-party payment providers and are not stored by us. For more information, please see our Privacy Policy.


8. Privacy and Data Protection

Your personal information is collected and processed in accordance with our Privacy Policy, which explains:

  • what data we collect,

  • how it is used,

  • how long it is retained, and

  • your rights in relation to your personal data.

By using this website or placing an order, you agree to this processing.


9. Limitation of Liability

To the fullest extent permitted by law:

  • our total liability shall not exceed the value of the Goods purchased, and

  • we shall not be liable for indirect, consequential, or economic losses, including loss of profit or business.

Nothing in these Terms limits liability where it would be unlawful to do so.


10. Force Majeure

Neither party shall be liable for delay or failure to perform obligations due to events beyond reasonable control, including war, fire, industrial disputes, civil disturbance, or supply chain disruption.

Obligations will be suspended for the duration of the event.


11. General

  • You must be at least 18 years old to place an order.

  • Delivery is available within the UK only, unless otherwise stated.

  • These Terms do not affect your statutory rights.

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.


12. Governing Law

These Terms, together with the Returns Policy and Privacy Policy, are governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
